Welcome to Innocre Telehealth. These Terms of Service ("Terms") govern your use of the website at innocre.org and the telehealth services provided by InnoCre ("InnoCre," "we," "us," or "our"). By accessing our website or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.

1. No Provider-Patient Relationship from Browsing

Use of this website, including browsing content, reading health articles, or submitting contact forms, does not establish a provider-patient relationship. A provider-patient relationship is established only after a clinical evaluation has been completed by a licensed Innocre provider during a scheduled telehealth visit.

The health information provided on this website is for general educational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider with any questions regarding a medical condition.

2. Acceptance of Terms

By creating an account, scheduling an appointment, or otherwise using our platform, you acknowledge that you have read, understood, and agree to these Terms and our Privacy Policy. If you are using our services on behalf of a minor or dependent, you represent that you have the legal authority to agree to these Terms on their behalf.

3. Description of Services

Innocre provides telehealth services including virtual medical consultations, diagnosis, treatment, and prescription services through licensed healthcare providers. Our services are delivered via audio and video communication technology and are designed for non-emergency medical conditions.

Our providers are board-certified and licensed to practice in the states we serve. Services may include urgent care visits, treatment for common conditions, prescription refills, and other clinical services as listed on our website.

4. Eligibility and Geographic Limitations

To use Innocre Telehealth services, you must:

• Be at least 18 years of age (or have a parent or legal guardian consent on your behalf)
• Be physically located in one of the states where we are licensed to provide care: Delaware (DE), Maryland (MD), or Washington (WA) at the time of your visit
• Provide accurate and complete information during registration and consultations

We are unable to provide services to patients located outside of our licensed states. It is your responsibility to confirm your location eligibility before booking a visit.

You may be required to create an account through our patient portal, powered by CharmHealth/CharmTracker, to access our services. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Please notify us immediately if you suspect unauthorized use of your account.

7. Prescription Policy

Our providers may prescribe medications when clinically appropriate based on your telehealth consultation. However, please note the following:

• We do not prescribe controlled substances (Schedule I-V) through our telehealth platform.
• Prescriptions are sent electronically to your preferred pharmacy.
• The decision to prescribe any medication is at the sole clinical discretion of your treating provider.
• Refill requests are subject to clinical review and may require a follow-up visit.

8. Payment Terms

Innocre Telehealth accepts both self-pay patients and select insurance plans. Key payment details include:

• Self-pay visits start at $68, depending on the type of service.
• If you have insurance, we will verify your coverage and bill your insurance carrier. You are responsible for any copays, coinsurance, or deductibles.
• Payment is due at the time of service unless other arrangements have been made.
• We reserve the right to adjust pricing with reasonable notice posted on our website.

9. Intellectual Property

All content on the Innocre website, including text, graphics, logos, images, design elements, and software, is the property of InnoCre or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on our site without prior written permission.

9a. Prescription Policy

Providers do not guarantee prescriptions. Any medication prescribed is based on a clinical evaluation, medical necessity, and compliance with applicable laws and regulations.

Certain medications, including controlled substances, are not prescribed via this platform.

10. Limitation of Liability

To the fullest extent permitted by law, InnoCre, its providers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or website. This includes, but is not limited to, damages for loss of profits, data, or other intangible losses.

Our total liability for any claim related to our services shall not exceed the amount you paid to Innocre for the specific service giving rise to the claim. Nothing in these Terms limits liability for gross negligence, willful misconduct, or any liability that cannot be excluded by law.

11. Disclaimer of Warranties

Our services and website are provided on an "as is" and "as available" basis. While we strive to provide high-quality care, we do not guarantee specific health outcomes. We make no warranties, express or implied, regarding the accuracy, reliability, or completeness of any information provided through our platform.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of our services shall be resolved in the state or federal courts located in Pennsylvania.

This website may contain links to third-party websites, including government health agencies, medical reference sources, and healthcare organizations. These links are provided for informational convenience only and do not constitute an endorsement, recommendation, or approval by Innocre Telehealth.
